Terms of service
Terms of Service
These Terms of Service (“Terms”) govern your use of cherishedgrace.shop and purchases from Cherished Grace. By using the site or placing an order, you agree to these Terms. If you do not agree, do not use the Services. “We,” “us,” and “our” refer to [REQUIRED BEFORE PUBLISHING — MERCHANT LEGAL NAME]. Shopify provides the commerce platform but is not the seller of our products.
1. Eligibility and accounts
You must be legally capable of entering a binding contract in your jurisdiction and provide accurate, current information. You are responsible for safeguarding account credentials and activity under your account. Notify us promptly of suspected unauthorized use.
2. Products and descriptions
We aim to display products, colors, dimensions, materials, and packaging accurately. Screen settings, handcrafted details, and production batches can produce reasonable variations. Decorative figurines, keepsakes, and ornaments are not toys unless expressly stated. Follow product-specific safety, care, and age guidance. Site content is general information and is not medical, counseling, or religious advice.
3. Prices, taxes, and payment
Prices and promotions may change before an order is accepted. Applicable taxes, shipping charges, and the final total are shown at checkout. You authorize us and our payment providers to charge the selected payment method. You represent that you are authorized to use it. Currency conversion and issuer fees are controlled by your provider.
4. Orders and acceptance
An order confirmation acknowledges receipt but does not guarantee acceptance. We may reject or cancel an order before shipment for suspected fraud, pricing or inventory errors, legal restrictions, payment failure, quantity limits, or inability to deliver. If payment was captured for a canceled order, it will be refunded. We may limit quantities per person, household, address, or order.
5. Shipping, title, and risk
Processing and estimated delivery are described in the Shipping Policy. To the extent permitted by law, risk of loss passes as provided by applicable law and carrier delivery records; nothing in this clause reduces non-waivable consumer protections. You are responsible for an accurate delivery address.
6. Returns and refunds
Returns, exchanges, damaged items, and refunds are governed by the Refund & Return Policy, incorporated into these Terms. Mandatory legal rights remain unaffected.
7. Intellectual property
The site and its original content, branding, graphics, photographs, text, layout, and compilation are owned by or licensed to us and protected by applicable laws. You may use the site only for personal, non-commercial shopping. You may not copy, scrape, reproduce, modify, distribute, sell, or exploit site content without permission, except where law permits.
8. Reviews and user content
If you submit a review, photograph, comment, or other content, you confirm you have the necessary rights and that the content is accurate, lawful, and not infringing, deceptive, abusive, or malicious. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt for formatting, and use that content in connection with the Services and their promotion, subject to applicable privacy and consumer-review laws. We may moderate content for lawful reasons but do not promise to review everything.
9. Prohibited uses
Fraud, impersonation, unauthorized payment activity, or unlawful purchases.
Introducing malware, bypassing security, probing vulnerabilities, or disrupting the Services.
Automated scraping or harvesting except as permitted by law or written authorization.
Infringing intellectual property, privacy, publicity, or other rights.
Using the Services to harass, deceive, or distribute unlawful or harmful content.
10. Third-party services and links
The Services may contain third-party tools, apps, payment methods, and links. Their terms and privacy policies apply to their services. We are not responsible for third-party content or services except to the extent applicable law provides otherwise.
11. Disclaimers
To the fullest extent permitted by law, the site and Services are provided “as is” and “as available.” We do not warrant uninterrupted or error-free access. Product warranties, if any, are those expressly stated or required by law. Some jurisdictions do not permit exclusions of implied warranties, so these exclusions may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, punitive, or consequential damages, or lost profits, revenue, data, or goodwill, arising from use of the Services. Our aggregate liability for a claim relating to a purchase will not exceed the amount paid for the product giving rise to the claim. These limitations do not apply to liability that cannot lawfully be limited, including where applicable fraud, willful misconduct, or death or personal injury caused by negligence.
13. Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights. This clause does not require a consumer to indemnify us for our own breach or misconduct.
14. Governing law and disputes
These Terms are governed by the laws of [REQUIRED BEFORE PUBLISHING — STATE/COUNTRY], without regard to conflict-of-law principles, except that mandatory consumer laws of your place of residence may still apply. Courts located in [REQUIRED BEFORE PUBLISHING — COUNTY/STATE/COUNTRY] will have non-exclusive jurisdiction, unless applicable law gives you another forum. No arbitration agreement or class-action waiver is included in this draft.
15. Changes and severability
We may update these Terms prospectively by posting a revised version. Material changes will be communicated where required. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue.
16. Entire agreement; no waiver
These Terms and the policies referenced here form the agreement concerning the Services and supersede prior related communications. A failure to enforce a provision is not a waiver.
